Supreme Court inatasan ang PAGCOR at PCSO na mag remit sa PSC

INATASAN ng Supreme Court ang gaming regulator PAGCOR at ang Phlippine Charity Sweepstakes Office (PCSO) na ibigay ang bahagi ng kanilang income para pondohan ang Philippine Sports Commission.

Ang pinakamataas na hukuman ng bansa ay pinairal ang petisyon na sinampa ng dating mambabatas Joseler Guiao noong 2016, na pilitin ang PAGCOR, PCSO at ang Office of the President na mag remit ng pondo sa PSC, na ipinag utos ng Republic Act 6847 or ang “The Philippine Sports Commission Act.”

Sa desisyon na inilabas Huwebes ng gabi, ang pinakamataas na hukuman ay pomabor kay Guiao.

“The Philippine Amusement and Gaming Corporation is ordered to account and remit the full amount of 5% of its gross income per annum, after deduction of its 5% franchise tax, from 1993 to present in favor of the Philippine Sports Commission,” ang decision ay sinulat ni Senior Associate Justice Marvic Leonen.

“Respondent Philippine Charity Sweepstakes Office is ordered to account and remit to the Philippine Sports Commission the 30% representing the charity fund of the proceeds of six sweepstakes or lottery draw per annum, including its lotto draws, for the years 2006 to present,” dagdag sa desisyon.

Inakusahan ni Guiao ang PAGCOR sa hindi pagsunod sa batas funding requirements. Nakasaad sa Section 26 na bahagi ng PCSO’s draws, pati ang PAGCOR’s income, ay mapupunta sa pagsuporta sa athletes sa international competitions gaya ng Asian Games, ang Southeast Asian Games at ang Olympics.

Samantala, nakipagtalo ang PCSO, na ang commission’s allocations ay magmula sa sweepstakes draws, hindi sa lotto games.

Gayunpaman, nakita ng Supreme Court na ang sports commission ay napabayaan sa loob ng ilang dekada.

“Without the necessary and sufficient funding for the Commission, one cannot expect it to efficiently fulfill its functions. Moreover, with insufficient funds, the entire existence of the Commission is made futile and its role in sports development and nation-building rendered nugatory,” Wika ng korte sa kanilang desisyon.

Ang ruling ay lumabas sa gitna ng panawagan ng malakas na suporta para sa Pilipinong atleta kasunod ng makasaysayang medal haul sa 2024 Paris Olympics. Carlos Yulo ay nagwagi ng 2 gold medal, habang si Aira Villegas at Nesthy Petecio nagwagi ng tig-isang bronze medal sa women’s boxing.
