Pangatlo na ito! SEN. DE LIMA HIRIT ULI NG PIYANSA!

INIHAYAG ng kampo ni Senador Leila M. de Lima na walang kredibilidad ang testigo ng prosekusyon dahil narin sa mga kontradiksyon at walang saysay na testimonya nito sa Muntinlupa City Regional Trial Court (RTC), Branch 256, matapos ang tatlong sunod-sunod na pagdinig na hindi nito dinaluhan.
Ayon kay Atty. Rolly Francis Peoro, abugado ni de Lima, magkaiba ang pahayag ni Engelbert Durano sa pagdinig nitong Martes kumpara sa testimonya nito noong Oktubre 2019, na nagdeliber siya ng pera sa noo’y Department of Justice Secretary na si de Lima sa loob ng New Bilibid Prison (NBP) noong Disyembre 2014 o ilang linggo bago isinagawa ang pinakamalaking pagsala-kay sa NBP sa pangunguna mismo ni de Lima.
“The Court’s stenographic notes will easily show that Durano’s testimony is full of contradictions. The alleged delivery is simply incredible, even a layman can easily detect the lies. It actually reminds us of the quote of Senator Roco regarding falsities where he said that ‘the problem with lies is they do not only quarrel with the truth. They also quarrel among themselves,” paliwanag ni Peoro.
Si Durano, dating pulis, ay nahatulan sa kasong Murder at Frustrated murder.
Inihayag ni Durano na ang P1.5 million ay galing sa isang alias “Jaguar” o Jeffrey Diaz, na nauna nang nagsabi na wala siyang alam na transaksyon kay de lima. Si Diaz ay napaslang ng mga otoridad sa Las Piñas City nitong Hunyo 2016.
“Durano earlier testified that the money he delivered was sourced from illegal drug transactions days before the December 15, 2014 Inter-Agency Blitzkrieg raid planned by the ISAFP, PDEA, PAOC, NBI and PNP. However, on cross-examination, he testified that the money was sourced from a stand by fund that came from outside the NBP, of which Durano, an inmate, could not exactly determine the source,” dagdag pa ni Peoro.
Aniya, sa mga naunang testimonya, sinabi ni Durano na wala siyang drug transactions at higit sa lahat ay wala siyang drug related transactions kay de Lima o kahit kanino pa, at iginiit niya na hindi na maaring mapatotohanan ang kanyang testimonya dahil ang mga tao na nakipag-ugnayan sa kanya ay patay na at maging ang text messages at phone calls ay wala narin sa kanya.
Pinaliwanag pa ni Peoro, sablay din sa usaping seguridad si Durano at kwestyonable ang sinasabi nitong inabot niya ang pera sa loob ng kahon ng sapatos kay de Lima.
“Durano testified that as a common practice in NBP, heightened and strict security measures, with full security detail, are always provided to all VIP visitors in the NBP, specially to the Secretary of Justice. BuCor officials from the Superintendent, the Commander of the Guards to BuCor guards, and Durano and his group of former police officers under the prison group Kalasag were tasked to secure the Secretary. However, on the alleged day he delivered money to then Secretary De Lima, she was inside the headquarters of the Commando gang in the company of hardened criminals, with only two security details,” ayon pa kay Peoro.
Aniya, mahirap din paniwalaan ang pag-abot ni Durano ng pera na hindi dumaan o inusisa ng grupong Commando gang. Dumalo si de Lima, ang pinakaprominenteng political prisoner sa ilalim ng administrasyon, sa pamamagitan ng teleconferencing mula sa PNP Custodial Center sa Camp Crame, Quezon City.
Naghain na ito ng kanyang ikatlong motion for bail, sa Muntinlupa RTC Branch 256 gamit ang dahilang kahinaan ng mga testigo laban sa kanya.
