DOJ HIRIT BAGONG JUDGE SA NALALABING KASO NI DE LIMA

HINIHILING ng Department of Justice (DOJ) panel of prosecutors na magkaroon ng bagong judge na didinig sa huling drug case ng nakakulong na dating Senador Leila de Lima.

Sa motion na isinampa nitong Huwebes, hirit ng DOJ prosecutors ang “voluntary inhibition” ni Muntinlupa City Regional Trial Court (RTC) Branch 204 Presiding Judge Abraham Joseph Alcantara, sa rason na ito ang parehong judge na nagbasura sa “near-identical case” laban kay Lima noong May 14.

Matatandaan na naipanalo ni De Lima ang dalawa sa tatlong drug cases na isinampa laban sa kanya.

“Having adversely decided against the People in the previous Criminal Case No. 17-165, the undersigned Panel of Prosecutors cannot help but be apprehensive that the Honorable Presiding Judge will carry over his perceptions to the instant case,” saad sa motion.

“Thus, to erase any doubt as to the impartiality of the Honorable Presiding Judge as well as to remove any impression that he will similarly decide on the instant case in favor of the accused, the prosecution most respectfully moves that the Honorable Presiding Judge voluntarily inhibit himself from hearing the instant case,” dagdag pa rito.

Ang unang may hawak ng kasong ito ay si Muntinlupa City RTC Branch 256 Presiding Judge Romeo Buenaventura. Pero bumitiw ito matapos ireklamo ng kampo ni De Lima, dahilan para muling i-raffle ang kaso at bumagsak sa sala ni Judge Alcantara.

Si De Lima ay nakakulong sa Camp Crame sa Quezon City simula pa February 24, 2017 – ilang buwan matapos siyang magsagawa ng Senate inquiry sa madugong giyera kontra droga ni noo’y President Rodrigo Duterte. Inaresto siya sa mga kasong siya’y sangkot sa kalakalan ng iligal na droga sa National Bilibid Prison na kanya namang itinatanggi. Ang mga testigo laban sa kanya ay nag-atrasan lahat matapos ang termino ni Duterte.
