Piston nagpasaklolo na sa Supreme Court vs jeepney modernization

NAGPASAKLOLO na sa Supreme Court (SC) ang Pinagka-Isang Samahan ng mga Tsuper at Opereytor Nationwide (PISTON) upang maharang ang modernisasyon ng jeepney at ang deadline ng franchise consolidation.

Hiniling ng PISTON sa Korte na maglabas ng temporary restraining order (TRO) laban sa Department Order (DO) 2017-011, Department of Transportation (DOTr) na Omnibus Franchising Guidelines (OFG), at ang franchise consolidation ng Land Transportation Franchising and Regulatory Board (LTFRB) na magpapaso na sa Disyembre 31, 2023.

Nakasaad sa petisyon na labag sa constitutional right, freedom of association ang mandatory consolidation requirement.

“The constitutionally guaranteed freedom of association includes the freedom not to associate. The Public Utility Vehicle Modernization Program (PUVMP) requires operators to consolidate their individual franchises into a single franchise under a cooperative or corporation. [The right to freedom of association] does not include the right to compel others to form or join [an association],” ayon sa pétition.

Sinabi ni Piston National President Mody Floranda, ang pagbawi sa prangkisa dahil sa hindi pagsali sa coop ay labag sa karapatan ng mga drayber at operator.

Pagkakaitan aniya sila ng kabuhayan dahil lamang sa hindi nila pagsali sa mga coop.
