Brgy Chairman, SK Chairman, 2 Kagawad at 2 opisyal nagpyansa para iwas aresto/kulong

NAGPIYANSA ang isang barangay chairman, SK chairman, dalawang kagawad at dalawang opisyal ng barangay para maiwasan ang pag-aresto at pagkakakulong matapos na sumampa sa korte ang reklamong Falsification of Official Document laban sa mga ito.

Kinilala ang mga nagpiyansa na sina na Barangay Chairman Ramil P. Sadicon, SK Chairwomran Vienna Ross Lyn Deveza, Kagawad Jonny P. Genon at Tessie R. Patacsil, Treasurer Baby Jane G. Cua at Secretary Bernadette A.Caindec, lahat ay pawang mga halal at appointed officials ng Brgy. 532, Zone 53, District IV, Sampaloc, Manila.

Sa isang opisyal na order na inilabas ng Manila Metropolitan Trial Court, Branch 6 na nilagdaan ni Presiding Judge Jerome U. Jimenez at may petsang November 5, 2024 para sa kasong Falsification under Art. 171, par 3, RPC, isinasaad na: “Finding the Application for Bail in order and accused Ramil P. Sadicon who voluntary appeared, posted his cash bail in the amount of Thirty-Six Thousand Pesos (Php 36,000.00) under O.R. No. 10202179 dated today, the same is hereby APPROVED, accused is granted provisional liberty pending trial.”

Samantala ay nagkaroon naman ng merito ang inihaing Motion for Reduction of Bail ng iba pang akusado at sa halip na magpiyansa rekomendadong halaga na P36,000 ay naging P18,000 na lamang ito.

“Finding merit in the Motion for Reduction of Bail filed by the accused Bernadette A. Caindec, Baby Jane G. Cua, Jonny P. Genon, Tessie R. Patacsil and Vienna Ross Lyn Deveza and there being no objection from the public prosecutor, the same is hereby granted provided accused posts bail in cash. Accordingly, accused are authorized to post cash bail in the amount of EIGHTEEN THOUSAND PESOS (Php 18, 000.00) instead of recommended bail of THIRTY SIX THOUSAND PESOS, for Falsification under Art.171, par. 3, RPC,” ayon pa sa opisyal na order na pirmado rin ni MTC Presiding Judge Jerome U. Jimenez at may petsang Nov. 5, 2024.

Itinakda naman ang arraignment at pre-trial ng mga nasasakdal sa December 13, 2024 ganap na 1:30 ng hapon.

Matatandaan na unang sinampahan ng reklamo sa OCP ng Maynila ni Kagawad Fernando E. Rongquillo ng nasabi ring barangay ang mga nasasakdal ng Falsification of Official Document kung saan nakitaan ito ng merito at sumampa sa korte.

Sa isang resolusyon na ipinalabas ng OCP ng Maynila at nilagdaan noong August 29, 2024 nina Senior Assistant City Prosecutor Christian Tracy B. Bachiller at Senior Assistant City Prosecutor Roberto Damian A Morico V ay lumilitaw na ang reklamo ni Ronquillo ay dahil ang kanyang pirma na orihinal na nakalagay sa isang draft document na kanyang ni-review at nilagdaan ay kanyang binawi dahil sa pagtutol niya sa ilang probisyon, pero ikinabit ng mga nasasakdal sa ibang dokumento.

“According to Ronquillo, the original draft was subsequently withdrawn. However it appears that the page containing his signature was removed from the withdrawn draft and attached to a different document. This act which missrepresent Ronquillo as having approved a document he did not, constitute a crime of falsification under Article 171, Paragraph 3 of the Revised Penal Code, ” ayon sa resolusyon.
