KUNG si Kin. Chel Diokno ng Akbayan Party List ang tatanungin, kailangan sansalain ng bayan ang Hudikatura dahil sa labis na katiwalian. Tiwali ang maraming mahistrado mula sa mababa hanggang sa pinakamataas na hukuman.
Ito ang dahilan sa mungkahi ni Diokno ng agarang paglikha ng isang congressional commission na susuri sa justice system ng bansa upang harapin at lutasin ang malalang isyu ng korapsyon na humaharap sa Hudikatura.
Kasama ni Diokno Sina Kin Perci Cendana at Kin Dadah Kiram Ismula ng Akbayan Party List sa pagtangkilik ng pagbuo ng isang Joint Congressional Commission on Justice System Reform (JUSTCOM) na susuri at magsisiyasat sa kabuuan ng justice system ng bansa upang harapin ang mga isyu sa Hudikatura.
“We need to make our justice system work. Without the necessary reforms, it will continue to remain slow and unequal–and the poor will continue to suffer the most. Cases must move faster than they do now,” ani Diokno.
Isinumite ni Diokno, Cendana, at simulan ang House Bill 7305 na nagmumungkahi sa pagtatayo ng JustCom. Kasama rin nila si Dinagat Islands Kin. Kaka Bag-ao.
Layunin ng HBN 7305 pag-usapan mga case backlogs, prolonged pretrial detention, jail overcrowding, limited access to legal assistance, weak accountability, and declining trust in the justice system sa pagbalangkas ng pangmatagalang pagbabago sa Hudikatura.
“The government has long neglected the justice system, giving it far less attention than it deserves. This bill is a step toward meaningful reform, ensuring that cases move faster, accountability is strengthened, and access to justice is no longer a privilege of the few,” ani Diokno.
Ayon saWorld Justice Project Rule of Law Index, pang-97 ang Filipinas sa 143 na nagbigay noong 2025 ng mababang prayoridad sa Hudikatura. Pang-13 sa 15 bansa ang Filipinas sa sa may mababang iskor sa civil at criminal justice administration.
Bubuuin ang panukalang Komisyon ng siyan na kasapi: tatlong senador; tatlong kongresista; at tatlong malayang eksperto mula sa civil society. May tatlong taon na mandando ang Komisyon upang gumawa ng “independent, system-wide assessment covering four pillars: law enforcement, prosecution, corrections, and community-based justice.”
“This enables policymakers to be at the forefront of identifying and addressing solutions to these deep-seated problems. JUSTCOM’s technical output will directly facilitate the crafting of legislation or congressional inquiries that can address these concerns,” ayon sa paunang paliwanag (explanatory note) ng panukalang batas.
Makikipagtulungan ang Komisyon sa mga ahensya ng gobyerno tulad ng Philippine National Police, Department of Justice, Office of the Ombudsman, Bureau of Jail Management and Penology, Bureau of Corrections, and the Department of Social Welfare and Development, kasama ang civil society, akademya, NGOs, and people’s organizations.
Isasagawa ang malawakan at pambansang konsultasyon, makikipag-usap sa mga stakeholders, at kalapin ang mga mahalagang impormasyon upang makilala ang mga structural, procedural, at policy bottlenecks na sanhi ng mabagal na pagbaba ng mga desisyon sa husgado.
Mula sa mga findings, magpapanukala ang JustCom ng Kongkreto, evidence-based policy at legislative reforms upang mapabuti ang accountability, transparency, efficiency, at human rights protection. Magsusumite ito annual reports at sa loob ng 90 araw pagkatapos ng tatlong taon mandando, magbibigay ito ng final report kasama ang National Justice Development Plan at ang draft Omnibus Justice Reform Act para aksiyunan ng Kongreso.
“Justice delayed is justice denied. With the creation of the JUSTCOM, we have the opportunity to finally build a system that works for all Filipinos—not just for the powerful,” ani Diokno.
