Hurisdiksyon ng Senado sa impeachment trial, kukuwestiyunin ni Bato

NAIS ni Senador Ronald “Bato” dela Rosa na maresolba ang isyu ng hurisdiksyon ng Senado bilang impeachment court laban kay Vice President Sara Duterte ngayong 20th Congress.

“Siguro ang pinakaunang motion ko is to determine whether or not the Senate of the 20th Congress is willing to be bound by the actions of the previous Senate. ‘Yun lang ang tanungin ko para masettle natin ‘yung issue on jurisdiction,” pahayag ni Dela Rosa sa press conference.

“Since the impeachment court asked the House whether it is willing to be bound by the actions of their predecessors during the 19th Congress, you can expect me also to raise the same question on the Senate floor once the session of the 20th Congress is convened,” ayon pa sa senador.

Matatandaang iniutos na ibalik ang mga articles of impeachment sa House of Representatives na layuning patunayan na hindi nalabag ang one-year bar rule sa konstitusyon ang impeachment complaint laban sa isang opisyal kada taon at ang kahandaan ng 20th Congress na usigin ang Bise Presidente batay sa impeachment complaint na inihain noong 19th Congress.

Nabatid na nasunod na ng Kamara ang unang requirement ngunit hindi pa nasusunod ang pangalawa dahil sa Hulyo 28 pa lamang magko-convene ang 20th Congress.

Una nang iginiit ni Dela Rosa na dapat pagdebatehan pa rin ang hurisdiksyon ng Senado sa ilalim ng 20th Congress sa impeachment complaint na inihain laban sa Bise Presidente noong 19th Congress, kahit na nagpalabas na ng mga kautusan ang Senate impeachment court sa prosecution at defense panel.
