SABLAY ANG IMPEACHMENT COMPLAINT LABAN KAY BBM

WALANG sapat na batayan para sumulong ang impeachment complaint laban kay BBM. Ito ang konklusyon pagkatapos busisiin ito ng House Committee on Justice na pinamumunuan ni Kin. Jinky Luistro ng Batangas. Malinaw na basura ito at sinayang ang oras ng mga mambabatas.

Sa pagdinig ng panel, isa-isang binutata ng mga mambabatas ang mga akusasyon laban kay BBM tulad ng kidnapping kaugnay sa umano’y ilegal na pagsusuko kay Gongdi sa International Criminal Court (ICC).

Kabilang sa mga akusasyong itinabla ng ilang mambabatas ang alegasyon ng paggamit ng droga, kabiguang i-veto ang ilang kwestyonableng probisyon sa national budget, kickback kaugnay sa flood control projects, at umano’y paggamit ng Independent Infrastructure Commission para lamang isalba ang ilang kaalyado.

Binigyang-diin din ng ilang kongresista na karamihan sa ebidensiyang kalakip ng reklamo ay pawang news articles lamang, at wala umanong opisyal na dokumento o sertipikadong rekord na magpapatunay sa mga naturang paratang.

Mismong ang isa sa mga masugid kritiko ni BBM – Kin. Leila de Lima – ang nagsabing hindi maituturing na kidnapping at illegal ang pagkaaresto at pag-entrega sa ICC kay Gongdi ay ginawa batay sa isang warrant sa ilalim ng isang international mechanism.

“Madam Chair, the first allegation is not a sufficient allegation of fact but mere conclusions lacking in its specificity. So, insufficient para sa akin yung first ground,” ani de Lima.

Sa kabuuan, magtapos busisiin ang iba pang mga alegasyon laban sa Pangulong Marcos, igiit marami sa mga miyembro ng komite na bagsak sa “sufficiency in substance” ang naturang impeachment complaint. Sa madaling sabi, maraming miyembro ng komite ang kumbinsidong kulang sa ebidensiya, sablay sa batayan, at hindi sapat para patalsikin si BBM.

Ibabasura lang ng komite ni Luistro ang dalawang impeachment complaint dahil sa kakulangan ng sustansya.

BABAGUHIN ng Camara de Representante ang mga alintuntunin sa impeachment, ayon sa isang mambabatas. Ibabatay ang babaguhing impeachment rules sa Saligang Batas at hindi ang ipinanukalang mungkahi ng Korte Suprema. Ito ang paglilinaw ni House Senior Deputy Majority Leader Lorez Defensor ng Iloilo.

Babaguhin ang impeachment rules batay sa intensyon ng mga gumawa ng Saligang Batas, ani Defensor. Kaya walang paglabag sa kakayahang magpasya, aniya.

“We don’t have to assert our independence. Our independence is laid down by the law,” ayon kay Defensor, isang abogado at chair ng Committee Rewriting of the the House Rules.

“There is a separation of powers kung saan dapat hindi lumalampas ang mga departamento sa isa’t-isa. The Legislative Department should not encroach on the Judicial Department and the Judicial Department should not also encroach on the Executive and the Legislative Department,” aniya.

“Wala akong nakikitang clear sign of grave abuse of discretion on the part of the rules of the House of Representatives,” Defensor said in stressing the doctrine of separation of powers. It follows the intent of the Constitution, especially when it comes to the initiation of impeachment complaints,” aniya.

“It bothers me that they are dictating how we interpret our session days. It bothers me that they are suggesting how we should proceed with impeachment referral especially if impeachment complaints endorsed by all members of the House of Representatives. Hindi na dapat sina-suggest ng Supreme Court kahit iginagalang natin sila kung paano ipo-proseso.”

Dagdag niya: “We will respect the Supreme Court ruling and we will see that the revised rules that we will approve. First of all, be aligned to the provisions of the Constitution and aligned with the intentions of the framers of the Constitution.

“Let’s leave the session days as it is but for impeachment complaints we will follow the Supreme Court that a session day is a calendar day without expressly saying that in the House of Representatives rules on impeachment.

“Mas malinaw lang ang ating magiging Rules on Impeachment as well as our internal procedures, we will make it more definitive para mas malinaw ang intention ng Constitution at framers ng Constitution,” ani Defensor.
