PAGBASA NG RULES PARA IWAS KALITUHAN, SAYANG ORAS, IPINANAWAGAN NI REP. JOEL CHUA

Malumanay na hinihimok ni Congressman Joel Chua (District 3, Manila), ang lahat ng kasamahan na lumalahok sa pagdinig na isinasagawa ng Kongreso sa impeachment complaint laban kay Vice President Sara Duterte na basahin ang mga alituntunin para magabayan sila at maiwasan ang anumang kaguluhan o mga katanungang maliwanag naman kung tutuusin dahil nga nasa rules naman.

Inihayag ito ni Chua bilang Vice Chair ng House Committee on Justice, habang isinasagawa ang nasabing pagdinig nitong Marso 18 lamang.

“I encourage all members, even non-members, to read the rules so we are not confused, and we could avoid questions when [the answers] are clearly stated in the rules,” ani Rep. Joel Chua.

Doon, kinwestiyon kasi ni SAGIP Representative Paolo Marcoleta kung bakit tinatalakay na kung meron ba o walang ‘sufficient grounds’ ang reklamong impeachment laban sa VP. Ngayon lang daw niya nadinig ang ‘sufficiency in grounds’ na termino.

“Since I was chief of staff here way back 2004 up to 2024, I’ve witnessed impeachment proceedings against presidents, one ombudsman, one chief justice. But I have not heard discussions on sufficiency in grounds. I’ve always heard sufficiency in form and substance. It’s only now that I heard about sufficiency in grounds,” ani Marcoleta.

Agad naman siyang sinabihan ni Committee chair Jinky Luistro na basahin ang Part 3 Rule III Section 7 ng House rules handbook ng 19th Congress, na ini-adopt naman ng 20th Congress: “After receipt of the pleadings, affidavits and counter-affidavits and relevant documents provided for in Section 6, or the expiration of the time within which they may be filed, the Committee shall determine whether the complaint alleges sufficient grounds for impeachment,” the provision reads.” Tila di pa rin nakuntento si Marcoleta dahil tinanong naman nito kung ang komite ba ay nasa proseso ng pag-alam kung merong “sufficient grounds for impeachment” o sila ba ay nasa hearing proper na.

Bago niyan, ilang ulit nang nabanggit sa mga pagpupulong na ang komite ay nasa ‘preliminary stage of deliberations’.

“We should have determined the sufficiency in ground before we voted for sufficiency in form and substance,” ani Marcoleta. Gayunman, nasa rules handbook pala na ang determinasyon ng ‘sufficiency in form and substance’ ay nauuna lagi.

“I wish to direct the Honorable Marcoleta to (read) the rules of impeachment. Secretariat, perhaps, we need to provide him a copy of the rules,” pahayag ulit ni Luistro.

Sa puntong ito ay sinusugan ni Rep. Chua ang sinabi ni Luistro kung saan hinimok niya lahat ng members at maging hindi miyembro ng nasabing komite na basahin naman ang rules para walang kalituhan at maiwasan ang pagtatanong ng mga bagay na maliwanag namang nakasaad sa rules. Oo nga naman.

Bagamat hindi siya miyembro ng justice committee, marapat lang siguro na basahin at pag-aralan ni Marcoleta ang lahat ng nauukol sa mga alituntunin ng mga pagdinig kung intensyon niya rin lamang na lumahok sa mga ito, lalo na kung ang kanyang intensyon ay kuwestiyunin ito.

Magsilbi sana itong aral sa mga mambabatas na matutong mag-research bago bumanat o magkuwestiyon nang sa gayon, hindi sila mabigyan ng lecture sa harap ng madla at national TV. Obligasyon nila ito bilang mambabatas, lalo na kung lalahok sa mainit na usapin gaya ng impeachment.
