VP Sara ‘di obligadong humarap sa Impeachment Court – Sen. Escudero

NILINAW ni Senator-judge Francis “Chiz” Escudero na hindi obligadong personal na humarap si Vice President Sara Duterte sa Senado bilang impeachment court, sa ikalawang araw ng paglilitis.

Lumutang ang isyu sa pagbubukas ng trial matapos tanungin ni private prosecutor Atty. Lorna Kapunan kung balak bang personal na dumalo ni Duterte sa imbestigasyon.

“If the Vice President is in the premises, does she intend to appear personally before the impeachment court?” tanong ni Kapunan, na nagsabing maaaring hilingin ng prosekusyon na humarap nang personal si Duterte.

Nauna rito, nagtungo si Duterte sa Senado upang makipagpulong sa kanyang defense team, ngunit hindi siya dumalo sa impeachment trial.

Sinabi ni Kapunan na maaaring ituring si Duterte bilang isang “hostile witness” kung saan nagpahayag na naghahanda ang prosekusyon ng written request upang obligahin siyang humarap kaugnay ng Article I ng Articles of Impeachment, na may kinalaman sa kasong grave threats.

“One of the key witnesses, though a hostile witness, would be the Vice President. Therefore, if we can inquire if it is her intention to appear in the premises of the Senate … we will file a written request for her presence,” sabi ni Kapunan.

Ayon naman kay Escudero, hindi sapilitan ang pagdalo ni Duterte dahil kinakatawan na siya ng kanyang mga legal na abogado.

“Whether she is in the building earlier or arrived after, it is totally up to the respondent because she is represented through her counsel,” din ni Escudero.

Idinagdag pa niya na kikilos ang impeachment court sakaling magsumite ang prosekusyon ng pormal na mosyon na humihiling sa personal na pagharap ni Duterte.

“Should the counsel for the prosecutors desire to call the respondent herself, the court will act on the motion once made or filed,” aniya.

Ayon naman kay Kapunan, inihain ng prosekusyon ang usapin upang malinawan ang mga maaari nitong hakbang habang pinag-iisipan kung hihilingin nitong obligahin si Duterte na humarap kaugnay ng kaso. (Mylene Alfonso)
