DEMANDA VS ILLEGAL CAMPAIGN POSTERS

PAHIHINTULUTAN ng Commission on Elections (Comelec) ang mga ilegal na campaign posters na manatili sa mga pribadong pag-aari, ngunit ang mga may-ari ay kailangang harapin ang kaso para sa election offense.

Ito ang paliwanag ng Comelec sa gitna ng reklamo mula sa kampo ng mga kandidato at kanilang supporters kaugnay sa Oplan Baklas.

Sinabi ni Comelec spokesman James Jimenez sa media na ang poll body ay maaaring maglabas ng bagong implementing rules and regulations (IRR) na mangangailangan ng written consent ng mga private property owners bago tanggalin ng mga tauhan ng poll body ang mga posters sa pribadong pag-aari.

“One of the biggest features of the planned IRR is that we will be requiring our field officials to get a written consent before they can enter into private property. The Comelec has always abided by the policy that we will not enter into private property unless there is consent by the property owner. We will take that a step further by requiring the officer to produce a written consent form. Written consent para malinaw to all and sundry na even if they are not there during the event at para may patunay tayo na nagbigay talaga ng paalam yung property owner,” sabi ni Jimenez.

Sakaling tumanggi ang may-ari, bibigyan sila ng abiso na tanggalin ang poster sa loob ng 3 araw o mahaharap sa kasong election offense kung saan sinabi ni Jimenez na maaaring pagkakulong, multa at maging disqualification sa paghawak ng pampublikong tungkulin.

“If the property owner refuses to give consent then a case is possible in the meantime the posters stay up,” ayon pa kay Jimenez.

Kinumpirma ni Comelec commissioner Rey Bulay, pinuno ng National Campaign Committee, na lalabas sila sa mga patakaran.

“The commissioners held an en banc meeting specifically para doon sa Oplan Baklas. What I proposed is the creation, the passing of an IRR kasi iba na sitwasyon ngayon, the law may have not evolved 21 years ago but situations change, you now have social media to ventilate yung mga ganiyan kaya ang drumbeating grabe,” ani Jimenez.
