KAUNA-UNAHANG PBBM APPOINTMENT KINASUHAN SA OMBUDSMAN

BUENAMANONG kasong administratibo at kriminal ang isinampa sa itinalaga ni Pangulong Ferdinand “Bongbong” Marcos, Jr. na hepe ng Philippine Ports Authority (PPA) sa Office of the Ombudsman
Ang mga kinasuhan ay sina Francisquiel O. Mancile, Assistant General Manager ng PPA; at Acting Division Manager niyang si Sesenio B. Sereno III, dahil sa pagkakasala ng ‘gross misconduct at conduct prejudicial to the service’.
Batay sa reklamo ni Genardo P. Mancio, acting manager ng Ports Police Department ng PPA, noong July 25, 2022 nagpalabas ng Order No. 2022 – 150 si Department of Transportation (DOTr) Secretary Jaime Bautista na nagsasaad ng: “In the exigency and best interest of the service and pursuant to the powers and functions vested to the Department Secretary, in Book IV Chapter 2 of Execeutive Order No. 292, Mr. Francisquiel O. Mancile, Assistant General Manager, is hereby designated as Officer-in-Charge (OIC) PPA.”
Noong September 21 ay agad namang naglabas ng Special Order No. 602 si Mancile para sa mga reassignment at designation ng Port Police Personnel at kabilang si Mancio, Jr. na nailipat mula sa pagiging Acting Department Manager (Superintendent) Port Police Department ay itinalaga bilang Station Manager A (Station Commander), PMO Masbate.
Pero ayon kay Mancio, bago ang pagpapalabas ng order, si Mancile ay sinabihan na siya ng mga Human Resource Management Department at Legal Services Department na si Attys. Mark Palomar at Rigel Caabay, na wala itong awtorisasyon na mag-isyu ng ganung kautusan dahil siya ay nasa OIC status lang.
Bagama’t alam naman ni Sereno na may iregularidad sa order ni Mancile ay agad itong nagsilbi bilang Acting Manager (Superintendent), Port Police Department.
Sa ilalim ng Article 177 ng Revised Penal Code, nagsasaad ng “Usurpation of Authority of official functions. Any person who shall knowingly and falsely represent himself to be an officer, agent or representative of any department or agent of the Philippine Government or of any foreign government, or who, under pretense of official position, shall perform any act pertaining to any person in authority or public officer of the Phillippine government, or of any foreign government, or agency thereof, without being lawfully entitled to do so, shall suffer the penalty of prision correctional in its miminum and medium periods.
Dapat umanong panagutin sina Mancile at Sereno sa kasong administratibo, grave misconduct at conduct prejudicial to the service, dahil bagama’t alam na nila na may iregularidad sa inilabas na order ay agad na ipinatupad ang pagtatalaga sa mga nabanggit na posisyon.
