4 PULIS INABSUELTO NG OMBUDSMAN SA 2016 PAYATAS ANTI-DRUG OPS

IBINASURA ng Office of the Ombudsman ang murder, frustrated murder, robbery, at planting of evidence charges laban sa apat na pulis na sangkot sa 2016 anti-drug operation sa Quezon City kungsaan isa sa mga suspek ang nagpanggap na patay upang makatakas.

Sa resolusyon na inaprubahan ni Ombudsman Samuel Martires noong June 5, pinaboran ng Office of the Ombudsman ang apat na pulis na sina Sr/Insp. Emil Garcia, PO3 Allan Formilleza, PO1 James Aggarao at PO1 Melchor Navisaga, pawang nakatalaga sa Quezon City Police District na nagsagawa ng anti-drug operation sa Barangay Payatas.

Base sa Ombudsman, nakasalalay ang ‘burden of proof’ sa complainants, na sa kasong ito ay mga kaanak ng umano’y drug traders na namatay sa operasyon, at si Efren Morillo na nakaligtas sa operasyon kahit na nabaril siya.

Subali’t, sinabi ng Ombudsman na hindi nakapagbigay ang complainants ng sapat na ebidensya laban sa mga pulis.

Anito pa, ang mga pagkasawi, bagama’t hindi nakalulungkot, ay bahagi ng operasyon at “justifiable”.

“The Office opines that the respondents were able to establish they were conducting a legitimate police operation during the anti-illegal drug operation. This is clear from the documents submitted by the respondents. It is unfortunate, however, that the police operation resulted in deaths,” saad sa 10-page resolution.

“In any case, acting in the fulfillment of a duty or in the lawful exercise of a right or office — as what the respondents did during the legitimate police operation — is a justifying circumstance under Article 11 of the RPC (Revised Penal Code),” dagdag nito.

Dagdag pa nito, ang testimonya ni Morillo ay itinuturing na suspek dahil siya ang subject ng operasyon. Gayundin, hindi personal na nasaksihan ng dalawang testigong iprinisenta ng complainants ang operasyon.
