ARREST WARRANTS NAKAAMBA LABAN KAY VHONG NAVARRO

DALAWANG arrest warrants ang nakaambang ilabas laban sa sikat na television host at comedian na si Ferdinand “Vhong” Navarro sa loob ng linggong ito ng dalawang babaeng judges sa Taguig City.

Si Regional Trial Court Judge Lorelie Datahan ng Branch 69 ang naatasang duminig sa ‘rape’ charge laban kay Navarro kaugnay ng ‘sexual abuse’ na isinampa ng model na si Deniece Cornejo noong 2014.

Ang ‘Rape’ o paglabag sa Revised Penal Code 266-A ay isang non-bailable offense.



Samantalang si Metropolitan Trial Court Judge Angela Francesca Din ng Branch 116 naman ang magdedesisyon sa kasong ‘Acts of Lasciviousness’ o paglabag sa Article 336 ng RPC.

Hindi katulad ng rape case, ang acts of lasciviousness ay mayroong piyansa.

Si Navarro ay inakusahan ng pag-abusong sexual kay Cornejo noong Enero 17, 2014 kungsaan naging headlines ito ng media. Ang comedian ay nasa kanyang katanyagan bilang contract actor ng ABS-CBN noong panahong iyon.

Subalit ibinasura ng Prosecutors’ Office ng Taguig City na nag-imbestiga sa charges na isinampa ni Cornejo dahil dahil kuwestiyunable umano ang mga iprinisintang ebidensya ng model.

Sina Judges Datahan at Din ang naatasan sa pamamagitan ng raffle para dinigin ang kaso na isinampa ng Taguig Prosecutors’ Office laban kay Navarro nitong nakaraang linggo.

Ang hiwalay na information sheets ay isinampa matapos pagtibayin ng Court of Appeals (CA) ang ‘petition for certiorari for issuance of a writ of mandamus’ na nag-atas sa Taguig prosecutors na magsampa ng kaso laban kay Navarro.



Sa desisyon na inilabas noong July 21, inatasan ng CA ang Taguig City Prosecutors’ Office “to file the Information against Ferdinand “Vhong” H. Navarro for: (1) Rape by Sexual Intercourse under Article 266-A (1) of the Revised Penal Code, as amended by Republic Act No. 8353; and (2) Acts of Lasciviousness under Article 336 of the Revised Penal Code.”

Sinabi ng korte: “It was erroneous for the DOJ (Department of Justice) to deny Cornejo’s petition for review on the ground that her statements int he complaint-affidavits are inconsistent and incredible.”

“In this regard, it bears to stress that the determination of probable cause does not depend on the validity or merits of a party’s accusation or defense or on the admissibility or veracity of testimonies presented,” saad ng appellate court.
