Sa sulat na ipinadala kina Major General Edgar Alan Okubo, direktor ng National Capital Region Police Office (NCRPO); Brig. Gen. Sidney Hernia ng PNP-Anti Cybercrime Group, at Maj. Gen. Jon Arnaldo ng PNP Directorate for Intelligence, sinabi ni Atty. Ananias Christian G. Vargas na marami nang pang-aabuso at paglabag sa karapatan ng kanyang kliyente ang ginawa ng PNP.
“By the time you receive this letter, it would have been at least seven (7) days since you stormed the premises of my client, Xinchuang Network Technologies Inc., on mere suspicions of acts of human trafficking through online means,” ani Vargas sa kanilang sulat.
“As you are very well aware, on June 30, 2023; Inquest proceedings have been conducted and concluded over certain foreign nationals that you randomly picked from among those whom you continuously detain within the premises of our client.”
“Never mind that these foreign nationals are not among those who are named in the Search Warrants and the Warrants to Search, Seize, and Examine Computer Data (WSSECD’s) dated 26 June 2023 – which is a procedural lapse that will be the subject of a different proceeding – but the fact that the inquest proceedings have been concluded, young implementation of the search warrants and WSSECD’s has thus unquestionably ended,” diin ng abogado.
Ang tanggapan, aniya, ng kanyang kliyente ay hindi isang detention facility ng Bureau of Immigration, lalo ang gawain ng naturang kagawaran ay labas narin sa trabaho ng PNP.
“As you are yet to produce any evidence of the crimes that you have been publicly imputing against my client, the urgency of acting upon your suspicions has undoubtedly lapsed. Hence, your opinion that the foreign nationals that your are detaining as victims,’ in need of rescue remain, simply, as such a mere opinion.”
“Worse, we have been validated reports and witnesses who will prove that you destroyed properties belonging to my client, including CCTV ca-meras, door locks, and other fixtures and items, and the one 124 safety deposit boxes or vaults that you removed from the premises and forcibly opened, but which are not even the subject of the warrants that you implemented,” saad sa liham.
Ipinagdiinan ni Vargas na ang patuloy na pagkumander ng PNP sa lugar ng kanyang kliyente ay malaking epekto sa operasyon ng opisina. “And deprivation of business and property without due process of law, not to mention and arbitrary and illegal detention of the persons that you continue to hold hostage therein.”
“You are hereby given a period of twenty four (24) hours within which to vacate the premises, return the 124 safety deposit boxes or vaults that you illegally seized and destroyed, including the contents thereof, and to pay the damages incurred by my client for a yet to be determined amount lest we be constrained to file the appropriate legal actions — criminal, civil, and administrative — against you and everyone under your command and implementing your illegal orders, without any hesitation,” pagtatapos pa nito.
