Kampo ni VP Sara umalma gawing testigo ang Bise Presidente laban sa sarili

PLANO ng House prosecution panel na iharap si Vice President Sara Duterte bilang testigo sa kanyang sariling impeachment trial kaugnay ng umano’y maling paggamit sa kanyang P612.5 milyong confidential funds.

Sa ika-23 araw ng impeachment trial nitong Martes, sinabi ni private prosecutor Lorna Kapunan na sa halip magpresenta sila ng 15 iba pang saksi, si Duterte mismo ang kanilang nais iharap bilang testigo para sa Article 1 ng Articles of Impeachment.

“In lieu of presenting 15 other witnesses, we will be presenting the Vice President herself as regards use, misuse, misappropriation of confidential funds, which is Article I of the Articles of Impeachment,” ani Kapunan.

Gayunman, nilinaw ni Kapunan na hindi pa sila humihiling ng subpoena laban sa Bise Presidente sa kasalukuyan.

Agad namang tinutulan ng kampo ni Duterte ang plano ng House prosecution na iharap siya bilang testigo sa kanyang sariling impeachment trial.
Ayon kay lead defense counsel Atty. Sheila Sison, hindi maaaring pilitin si Duterte na tumestigo laban sa kanyang sarili dahil protektado ito ng karapatan laban sa self-incrimination sa ilalim ng Article III, Section 17 ng 1987 Constitution na “No person shall be compelled to be a witness against himself No person shall be compelled to be a witness against himself.”

“This right is absolute and this is not only a simple right or a statutory right. This is a fundamental right. This is a right emanating from the Constitution itself and one that emanates from the guarantees under Article 3 of our 1987 Constitution,” hirit ni Sison.

Giit din ni Sison na itinuturing na naroroon ang Bise Presidente sa paglilitis sa pamamagitan ng kanyang mga abogado, kaya hindi kinakailangang personal siyang humarap bilang testigo.

“If respondent is not interested in this trial, she would not have even sent her lawyers to defend her in this case,” punto niya.

Samantala, sinabi ni Senate impeachment court presiding officer Sen. Francis Escudero na wala pa siyang desisyon sa usapin hangga’t hindi naghahain ng pormal na mosyon ang prosekusyon at nakapagsusumite ng komento ang depensa. (Mylene Alfonso)
